MURALL CLIMBING CENTRE RULES AND REGULATIONS
1. Definitions
Centre — the Murall climbing facility operated by the Company, located at 218 Górczewska Street, 01-460 Warsaw; warszawa-gorczewska@murall.pl
Reception — the email address for submitting Group Supervisor Statements and Parental/Guardian Consents for Minors: recepcja-gorczewska@murall.pl
Child — a child under 10 years of age
Minor — a person aged 10 until reaching the age of majority
Rules and Regulations — these Rules and Regulations

Group Supervisor Statement — a statement submitted by the supervisor of an organised group using the Centre's designated form
Parental/Guardian Consent — a statement made by the legal representative or guardian of a Minor using the Centre's designated form
Climbing Wall — a wall intended for sport climbing or a bouldering wall
2. Risk and Liability
2.1. Climbing is a high-risk sport and may result in bodily injury or, in exceptional cases, even death. The Centre makes every effort to ensure the safety of climbers by using certified equipment and providing training upon request. These measures increase safety but do not guarantee it absolutely. Climbers use the Centre at their own responsibility and risk.
2.2. Failure to comply with the safety rules set out in these Rules and Regulations is considered particularly hazardous to the health and life of the Centre's customers. A person who violates the safety rules, or the person responsible for such individual (in the case of Children and Minors), shall bear full responsibility for any consequences arising for themselves or third parties.
2.3. Any violation of safety rules and any injuries sustained must be reported to a Centre employee immediately.
2.4. The Company shall not be liable for personal injury resulting from the use of the Centre, except for injuries caused by malfunctioning equipment intended for climbing or other activities available at the Centre.
3. Rules for Individual Entry
3.1. Acceptance of these Rules and Regulations and registration of a user account are required in order to use the Centre.
3.2. The current Rules and Regulations are available in printed form at every Murall Centre and on the website, and are also provided during the user account registration process. Acceptance of the Rules and Regulations is a one-time requirement and remains valid until withdrawn. In the case of Minors and Children, their legal representative is responsible for familiarising them with the Rules and Regulations. Future updates to the Rules and Regulations will be sent by email to the address provided in the user's profile. It is the user's responsibility to familiarise themselves with any updates received. Updates to the Rules and Regulations do not require the user's renewed acceptance. If the user does not agree to an update, they may withdraw their acceptance of the Rules and Regulations by email. Upon withdrawal of acceptance, the user loses the right to enter and use the Centre.
3.3. A user may register an account by downloading the Murall mobile application, via the website (www.murall.pl), or at the Centre. Registration is completed once and remains valid until withdrawn. Registration grants access to all Murall facilities. During registration, the user confirms that they have read and accepted the Rules and Regulations. In the case of a Child, the registered user may only be their legal representative, who shall supervise the Child during their stay at the Centre.
3.4. The scope of activities permitted at the Centre for each user group is specified in the table below. All persons using the Centre for the first time, regardless of their level of knowledge or skills, are required to report this to Reception and undergo an introductory briefing, which consists of theoretical instruction on the rules for using the Centre, including the use of the automatic belay system.

3.5. If a user or their Guardian considers that the briefing referred to in Section 3.4 is insufficient to begin climbing independently, in particular where practical training is required, they must report to an Instructor or Reception at the Centre to arrange appropriate training.
3.6. The Centre does not provide supervision or childcare for Children or Minors. The use of the Centre by a Child or Minor, including use under the supervision of or with the consent of a Guardian, takes place solely at the Guardian's risk. The provisions of this section also apply to the period before and after organised activities conducted by the Centre's Instructors.
3.7. Children may only remain at and use the Centre under the constant supervision of a Guardian or an Instructor conducting activities with the Child. Children are not permitted to move independently to areas other than the area where their Guardian or the Instructor conducting the activities is present.
3.8. Minors may enter the Centre independently only with Parental/Guardian Consent (the Centre's designated form applies). The Parental/Guardian Consent must be delivered in printed and signed form to Reception or sent to the Reception email address specified in Section 1 as a scanned, signed document using the template attached to these Rules and Regulations. Consent is provided once and remains valid until withdrawn.
3.9. Before beginning climbing or exercising in a specific area of the Centre, users must familiarise themselves with the detailed guidelines applicable to that area. In case of any doubt, they should contact a Centre employee.
3.10. Animals may be brought into the Centre provided that they remain on a leash. In the case of dogs, the use of a muzzle is recommended. The person responsible for an animal visiting the Centre bears sole responsibility for it.
4. Rules for Organised Groups
4.1. Entry of organised groups, including groups participating in sports activities, trips, birthday parties, team-building activities, etc., requires prior reservation and confirmation from the Centre regarding the availability of places and Instructors.
4.2. If members of an organised group are Children or Minors, the use of the Centre's training facilities requires the presence of a dedicated Centre Instructor assigned to the group. The Instructor determines the scope of activities permitted for the group members.
4.3. Before each activity begins, the Group Supervisor is required to submit a signed Group Supervisor Statement using the Centre's designated form, either in printed and signed form to Reception or as a scanned, signed document sent to the Centre's Reception email address specified in Section 1. The Group Supervisor is responsible for providing all group members with the contents of the Rules and Regulations.
5. Safety and Property
5.1. Climbing and exercising at the Centre after consuming alcohol or while under the influence of intoxicating substances is strictly prohibited.
5.2. Only climbers and belayers may remain in the immediate vicinity of climbing walls. For safety reasons, children are strictly prohibited from playing in this area. Leaving unsecured belongings on climbing mats or in the immediate vicinity of climbing walls is prohibited.
5.3. Before climbing, all jewellery (e.g. earrings, rings, necklaces, bracelets) must be removed, and all heavy objects (e.g. phones, keys) must be taken out of pockets.
5.4. Climbing is permitted only with certified equipment bearing UIAA, CE or DIN certification, including privately owned equipment. Centre staff may inspect customers' equipment and, if any irregularities are found, prohibit its use.
5.5. Climbing is permitted only in specialised climbing shoes. For the avoidance of doubt, ordinary sports shoes, approach shoes, flip-flops and sandals do not meet this requirement. Climbing barefoot is strictly prohibited.
5.6. Climbing is permitted only on prepared surfaces and holds. Grabbing or standing on belay elements or structural components is prohibited. It is prohibited to climb using an auto-belay while simultaneously clipping a rope in a manner that imitates lead climbing.
5.7. Wearing headphones while climbing in the high-wall area is prohibited.
5.8. All courses and training sessions organised and conducted at the Centre may only be provided by Centre Instructors. Unauthorised installation of belay devices or specialised training equipment on the walls (e.g. for ice climbing, rope techniques or slacklining) is prohibited.
5.9. Persons who damage the Centre's equipment shall be financially liable for the resulting damage. Guardians shall be responsible for damage caused by Children and Minors.
5.10. Users of the Centre are responsible for properly securing their personal belongings. The Centre shall not be liable for any resulting loss, including items left at the Centre. Lost property found on the Centre's premises will be systematically disposed of.
5.11. In matters not specified in these Rules and Regulations or requiring subjective determination, the final decision shall be made by a Centre employee.
6. Personal Data and Image Rights
6.1. The Company is the controller of the personal data of the Centre's customers.
6.2. Providing personal data is voluntary. Personal data is used by the Company and its affiliated companies to provide and offer their own services.
6.3. Persons using the Centre consent to the free-of-charge use and dissemination of their image recorded during their stay at the Centre for the Centre's promotional purposes by the Company. The consent is granted for an indefinite period and without territorial limitations.
6.4. Personal data will be stored for one year from the date on which a registered user notifies the Centre that they have ceased using its services. In the event of personal injury or property damage, personal data will be processed until all proceedings related to such event have been concluded.
6.5. Every person has the right to access and correct their personal data. Anyone may request the deletion of their data and cessation of its processing by the Company.
6.6. The full information clause concerning the processing of users' personal data by the Company is available on the Centre's website at www.murall.pl.
7. Online Ticket Sales
7.1. The Company sells admission tickets online.
7.2. When placing an order via the website, the purchaser selects the date or period, specifies the number of tickets and the payment method. The purchaser is also required to read and accept the payment terms and conditions.
7.3. Payment-related complaints are handled by the payment system operator. Other complaints should be sent by email to warszawa-gorczewska@murall.pl. Complaints will be considered within 14 days.
7.4. By making an online payment, the purchaser purchases the right of entry for a precisely specified date or period.
7.5. Pursuant to Article 38(12) of the Polish Consumer Rights Act of 30 May 2014, a ticket purchaser does not have the right to withdraw from a distance contract, as this right does not apply to contracts for leisure, entertainment or sports-related services where the contract specifies a particular date or period for the provision of the service.
7.6. All provisions of Section 3 of these Rules and Regulations apply to Children and Minors. If the applicable requirements are not met, such a person will not be permitted to enter the Centre despite having purchased an online ticket, and the Centre will not be obliged to refund the amount paid.
7.7. The Centre shall not be liable for an unsuccessful order, failure to deliver a confirmation, or inability to make a payment where such circumstances were caused by providing an incorrect or inaccurate customer email address, Internet network problems, or other circumstances beyond the Centre's control.
